How your information will be used
Information you provide to this website may be stored and used to provide services to you.
We require an email address to idenitfy the account holder. This will not be shared with any other website or service. It is used to send you notifications about your account and perform administrative tasks such as resetting your password. You have the option to opt-out of all email notifications through your settings.
Communication channels created on this website require a name and a photo or avatar. A default avatar will be chosen if you do not supply one. The name, avatar, and a link to the channel webpage will be shared with other servers and services in order to refer to this identity. The name does not need to be your real name and the photo or avatar does not need to resemble you.
All other information you supply to this website is optional.
As a social communication and cloud storage service, you will usually be using this website to share information with others. We provide a range of privacy options to allow you to restrict this sharing to only those you choose.
Processing of your information
Our processing of your information is limited to storing it for you to use. We MAY keep logs of activity to help diagnose software issues and to maintain security of the system against intrusion. These logs are routinely deleted after a few days.
We MAY (if you have provided this permission) try to suggest frendships or connections based on analysing publicly available information about your connections. This is currently the most advanced data "processing" performed at this website. You may restrict access to this information if this processing is undesired.
If supplied, we MAY use your gender to formulate text messages in your native language, for instance "Bob commented on HIS post."
We do not share your private information with third parties or analyse your behaviour or personal characteristics. We have no advertisements or business relationships with advertisers.
We MAY be asked or forced to divulge information provided by you in response to legitimate criminal and legal proceedings. Where possible we will notify you if this happens.
Access to your information
Some communications are shared with other websites. Those using the same software will usually have similar privacy policies.
You may be shown embedded videos and provided links to visit other websites as part of your day-to-day activities using this website. This MAY expose you to monitoring by external services, such as (but not limited to) Facebook, Twitter, and Google. Each website operator is allowed to configure whether or not embedded content is permitted.
Further access to your personal data and stored files is under your control.
Our storage of your data is provided under your implied consent through your continued use of the service. You may withdraw this consent at any time and on account deletion we will remove all data which belongs to you. The process of deletion may take several days as we also make a good faith effort to delete it from any internetworked websites that have been provided a copy.
All data and files stored for a communications channel are available for you to download for either archival puposes or to transfer to another compatible website.
Under the General Data Protection Regulation (GDPR) and The Data Protection Act 2018 (DPA) you have a number of rights with regard to your personal data. You have the right to request from us access to and rectification or erasure of your personal data, the right to restrict processing, object to processing as well as in certain circumstances the right to data portability.
If you have provided consent for the processing of your data you have the right (in certain circumstances) to withdraw that consent at any time which will not affect the lawfulness of the processing before your consent was withdrawn.
You have the right to lodge a complaint to the Information Commissioners’ Office if you believe that we have not complied with the requirements of the GDPR or DPA 18 with regard to your personal data.

IMPORTANT NOTES: This document is only a translation of the "Regulamin portalu H1.HUBZILLA.PL" at URL https://hubzilla.pl/legal/SiteTos and is intended to inform users who do not speak Polish about the rules of using the HUBZILLA.PL Service. Any disputes will be resolved in accordance with the Polish document.
1. General Provisions
1.1. This document ("Terms") defines the rules for the provision of electronic services via the website, located in the h1.hubzilla.pl domain ("Hub"), for end users of the Internet network, visitors to the Hub ("Visitors", "Readers" ) and users registered on the Hub ("Users").
1.2. The Portal is provided by ISFERA.ORG Group, represented by Andrzej Budziński, which uses the postal address: POLAND FUP Kraków 1 skr. 41, 31-151 Kraków, ul. Rynek Kleparski 15, and the e-mail address: firstname.lastname@example.org ("Service Provider") as their contribution to the Hubzilla project
1.3. The Terms are the regulations referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services (Dziennik Ustaw 2002 No. 144 item 1204).
2. Services and Use of Service
2.1. The provision of services consists in enabling Users to use the functionality of [Hubzilla platform] (https://hubzilla.org), which is hosted by the Service Provider as a social networking portal of the federal network [Zot] (https://zotlabs.org/page/zot/zot + about) and [Fediverse] (https://en.wikipedia.org/wiki/Fediverse) as specified in the offer at https://hubzilla.pl/offer.
2.2. The detailed scope of functionalities supported on the Hub is described at the website https://hubzilla.pl/about/.
2.3 The User may not use the Hub to perform illegal activities, violate these Regulations and the rules of netiquette published at https://en.wikipedia.org/wiki/Etiquette_in_technology#Netiquette. In particular the User is no allowed to:
a) have more than one account on the Hub;
c) publish content that infringes the rights of others, including intellectual property rights;
d) post content that is intentionally misleading, fraudulent, discriminatory, hateful, inciting violence;
e) post pornographic or obscene content on public channels;
f) distribute malware and take actions to disrupt the operation of the Hub.
2.4.The terms of service depend on the type of account the User has at the Hub. The following classes of service and account types are offered:

2.4.1. The "Start" account is automatically granted to each User as a result of successful registration.
2.4.2. The "Standard" account is aimed at people who want to support the development of the Hubzilla project, as active members of the Hubzilla project community and contribute to its development in various forms. It is granted for a period of 1 year.
2.4.3. Any registered user of the Portal may apply for a "Standard" account, but in the case of a "Start" account holder only three months after registration, if:
a) the User did not violate the Regulations during the period of having an existing account,
b) the User will be pledge your support for the Hubzilla project in whatever form as described at https://hubzilla.pl/offer.
For this purpose, the User should send an appropriate application to the Hub administrator. The Hub Administrator, evaluating this application and making a decision, is guided by the good of the Hubzilla project community and the technical possibilities of hosting. Priority is given to current "Standard" account holders who request an account renewal.
2.5. The use of the Hub's services is free of charge as regards the "Start" and "Standard" accounts, which does not exclude the possibility of introducing certain additional paid services or paid accounts or voluntary forms of project funding, or limiting access to services for certain accounts to specific groups of users. If such solutions are introduced, the User will each time receive relevant information in this regard, enabling him to make an informed decision about using paid services and making voluntary payments.
2.6. The Service Provider reserves that it may introduce a limitation in the number of new Users.
2.7. The Service Provider reserves that the functioning of the Hub may be closed without giving reasons. In this case, Users will be notified of this fact one month in advance, which will enable them to recover all their data stored on the Hub or transfer them to other hosting services of the Hubzilla platform.
3. Registration on the Service, Membership, Conclusion and Termination of the Contract for the Provision of Electronic Services
3.1. A member of the Hub may be a natural person over 18 years of age who, after accepting the provisions of the regulations, will complete the registration procedure, successfully opening an account.

3.3. To register, one need to:
1) complete the form on the Registration page, available at https://h1.hubzilla.pl/regiser URL;
2) accept the regulations of the Terms by checking "yes" in the statement: "I am over 18 years old and I accept the Terms of this website";
3) submit this form by clicking the "Register" button;
4) confirm your willingness to register by clicking the special link contained in the body of the e-mail message, which you will receive to the e-mail address you provided;
5) obtain approval of the registration, which is issued by the Hub administrator after checking the registration application.
3.4. The Hub Administrator may refuse to accept the registration application if it finds that the registrant:
a) is under 18 years of age,
b) already has an account on the Hub and is now trying to set up another one using a different identity,
c) already had an account on the Hubzilla.pl's Hubs, which was blocked and removed due to the fault of this person,
d) uses the IP address or e-mail address that are on the "blacklists" of both the Fediverse community and anti-spam programs,
or for technical reasons such as the accounts limit being exhausted.
3.5. As a result of successful registration, resulting in the creation of a "Start" account and automatic creation of a default profile and channel of the User, an agreement is concluded between the Service Provider and the Service Recipient for the provision of electronic services, in accordance with the Act of July 18, 2002 on the provision of electronic services
3.6. The User Account may be blocked if the Service Provider determines that the User:
a) violates the provisions of the Terms,
b) has not logged into the Hub for a period longer than 12 months,
c) has more than one account - in this case all his accounts are blocked.
3.7. After blocking the account, the User will receive forthwith an appropriate e-mail with a request to explain the situation that caused the blocking of the account. If the submitted explanations are not satisfactory or the Service Provider does not receive a response to the notification of blocking the account (s), an e-mail will be sent to the User requesting him to download the User's within 7 days, after which his account, channels, identities and related data will be removed from the Hub.
3.8. The User Account may be deleted by either the User himself or the Service Provider in the manner described in par. 3.9. Removal of the account terminates the contract for the provision of electronic services concluded between the User and the Service Provider.
4. Posting and Publishing Content
4.1. Any content may be posted and published on the Service, subject to par. 2.3.
4.2. Content that may arouse public outcry or objection should be made available only to a limited group of Users and be published with the mark "NSFW" (Not Safe For Work). This also applies to "Adults Only" content.
4.3. The User is obliged to monitor the publication of his content and moderate comments posted to them by other Users.
5. Licenses and Content Rights
5.1. All data posted by you on the Service, both in the form of files and content entered by you into service database ("User Content"), are your property and only you decides how to share and publish them.
5.2. You represents and warrants that you are the original author of the User Content and have exclusive rights to them, including the right to grant all rights and licenses set out in these Regulations, or you have the right to publish User Content you didn't create, without the need for the Service Provider assuming obligations to third parties or liability for the use of such rights and licenses.
5.3. The User Content publications are subject to [CC BY-SA 4.0 License (Attribution - Share Alike)] (https://creativecommons.org/licenses/by-sa/4.0/legalcode.pl). You agree that you voluntarily grant this license for all the User Content you will be publishing and you ensure that the use of this license does not infringe the copyrights of any third party to the User Content.
5.4. All rights to the materials constituting part of the Service (including, but not limited to, designs, texts, graphics, images, videos, information, applications, software, music, sounds and other files, their compilation and arrangement), with the exception of User Content and shares in them, collectively referred to as "Website Materials", constitute the property of the Service Provider and the Service Provider's external licensors in the relationship between the User and the Service Provider. The User acknowledges and agrees that he does not acquire any proprietary rights by downloading and using the Website Materials.
6. Disclaimer of Warranty
THE SERVICES AND THE SERVICE MATERIALS ARE PROVIDED "AS IS" AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. IN ADDITION, WHILE THE SERVICE PROVIDER ATTEMPTS TO PROVIDE A GOOD USER EXPERIENCE, WE CANNOT AND DO NOT REPRESENT OR WARRANT THAT THE SERVICES WILL ALWAYS BE SECURE OR ERROR-FREE OR THAT THE SERVICES WILL ALWAYS FUNCTION WITHOUT DELAYS, DISRUPTIONS, OR IMPERFECTIONS. THE FOREGOING DISCLAIMERS SHALL APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
7.1. The User who posted or published or shared the User Content is solely responsible for it. This also includes its liability for damages that may arise from the dissemination of harmful files (cybercrime), dissemination of false, offensive, obscene or discriminatory content or content that infringes copyrights.
7.2. The User is solely responsible for his interaction with other Website users and other persons with whom he / she comes into contact through the Service. The Service Provider hereby excludes any liability to the User or third parties related to the use of the Service by the User. The Service Provider reserves the right to intervene, but has no obligation to manage disputes between the User and other users of the Service.
7.3. You agree to indemnify and hold the Service Provider, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney's fees, arising out of or in connection with:
1) your use of and access to the Service;
2) your violation of any term of these Terms;
3) your violation of any third party right, including without limitation any copyright, property, or privacy right or any third party agreement;
4) any of Your Content or information in your Account or any other information you post or share on or through the Service. As used in this section, "you" shall include anyone accessing the Service using your password
5) cyber crime;
6) a breakdown or an incident at the hosting infrastructure provider;
7) other factors independent of the Service Provider.
7.4. The Service Provider provides Users with Internet applications in accordance with the licenses applicable to these applications, and you agree to the provisions of these licenses, including the clauses regarding the exclusion of liability of software authors and distributors for express and implied damages caused by the use of this software, and acknowledges that the clauses these also extend to the Service Provider, releasing it from liability for such damages.
7.5. The Service may contain links to content posted on other websites. This does not mean that the Service Provider or the authors of the content posted on the Website take a position on the content posted on such pages or are responsible for it.
8. Complaints and Support
8.1. Complaints and reporting problems related to the functioning of the Website or requests for technical support in the scope of services provided on the Service (all called "service request") should be reported by e-mail to the address email@example.com.
8.2. Service requests should include the date and time of the event which is the subject of the complaint, the e-mail address of the claimant and a brief description of the reported reservations or problems. They will be dealt with as soon as possible.
9. Final Provisions
9.1. The law applicable to the obligations arising from these Regulations is Polish law.
9.2. The Service Provider reserves the right to update these Terms, which we may do for reasons that include, but are not limited to, complying with changes to the law or reflecting enhancements to the Service. If the changes affect your usage of the Service or User's legal rights, we’ll notify you no less than fourteen days before the changes take effect. Unless we state otherwise, your continued use of the Service after we post modifications will constitute your acceptance of and agreement to those changes. If you object to the changes, your recourse shall be to cease using the Service in accordance with para. 3.10 of the Terms.
